Success in delivery of a project or as some term them deliverable(s) depends on your position in the contracting relationship. Whether you are the owner (employer), contractor or consultant you each look on profit as a successful outcome. Each party is willing to accept some risk but the type of contracting relationship you select and the contract you sign will determine if you will be asked/able to accept/transfer risk. This presentation will seek to address these issues.

    • Examination of different types of contracting systems with an analysis of risk/benefit to owner/contractor
  • Design Process
  • Discussion
    • Interpreting the contract documents
    • Value Engineering/Value for Money analysis as part of regular design process
    • Problematic clause analysis-potential for future claims
    • Constructability Review –Who’s Responsibility?
    • Liability to the contractor - Exculpatory Clauses
  • Project Management Exercise
    • What is role and responsibility?
    • How impacted by CCDC?

Day II

  • Tendering Process
    • Quality Control of Tender Documents (Drawings and Specifications)
    • Site Visits
    • Amendments to tendering documents - is there a point at which re-tender should be looked at?
    • Contractor’s queries - how to handle/organize
    • Separate Contracts
    • Opening of Tenders
    • Award of Contract
  • Workshop - Project Problem
    • Participants will meet in small groups to discuss and suggest the solution to a case study problem that will be presented (Participants may also define a problem from their experience). A representative from each group will present the solutions to all participants. A discussion will follow.

Dr. Richard Beifuss, P. Eng., C. Arb. (Chartered Arbitrator), Mediator, Ph.D is President of Beifuss International. He has over 30 years experience in the Canadian industry and government, in the former as an engineering consultant (employee and partner), in the civil service as a manager of technical resources (electrical), project manager, technical expert, program manager and director. He has extensive expertise in alternate (appropriate) dispute resolution in diverse claims. He is a director/co-designer of Public Works= Contract Disputes Advisory Board.

Richard is a speaker and lecturer to Groups (National and International) on diverse professional development courses including ADR and Contract Claims Management and Avoidance. Cancellation Policy
If you wish to withdraw from a course, you must advise us, in writing, including the official receipt. Our policies regarding refund are:

More than fifteen business days in advance: a full refund minus $50.00 administration charge.

Fifteen or less business days in advance: a transfer to another course or a credit, valid for one year, to another GIC course can be considered. Credits are transferable within your organization.

If the course has been running for more than 2 weeks, or after the course has started, an 80% credit towards another GIC course may be considered, if notice is received before the start date of the second session. After this time, no refunds or credits will be issued. If a speaker is not available due to unforeseen circumstances, another speaker of equal ability will be substituted.

GIC reserves the right to cancel or change the date or location of its events. GIC's responsibility will, under no circumstances, exceed the amount of the fee collected. GIC is not responsible for the purchase of non-refundable travel arrangements or accommodations or the cancellation/change fees associated with cancelling them. Please call to confirm that the course is running before confirming travel arrangements and accommodations.

Refund Policy: Allow up to 30 days for refunds to be processed.
